Question by realistnola: Are Illegal Aliens “subject to the jurisdiction” of the USA?
If they can call the Russian or Mexican or Indian embassy to get them out of jail, are they “subject?” And if not, do their kids actually fall under the 14th amendment to become automatic citizens?
I love the answers from people who speak well but have no clue about the law. Wonderful.
If you are married to an illegal or your in-laws are or you are the child one illegals, that does not change the reality or the illegality.

The more so. They will get abused. illegal aliens are more a danger to themselves. Every body tends to abuse them and black mail them into doing things they would not do if they were legal. Every one born on the US is a citizen and that is the way it should be. It is the same all around the world.

Aliens? As in extraterrestrials? No. People from other planets are not subject to USA jurisdiction.
Basically Subject to the jurisdiction … specifically was aimed at native Americans and those Foreign Diplomats with diplomatic immunity. illegal aliens are subject to arrest and conviction for any crime committed in US.
Subject to the jurisdiction means that the US can enforce its laws against them. If they are not subject to the jurisdiction of the US, then US laws are irrelevant to them, so their immigration status is a moot point.
btw, no embassy can get anyone out of jail.
Yes, everybody(legal or illegal) on US soil are “subject to the jurisdiction” of the USA. Hence their kids who are born on US soil fall under the 14th amendment and become automatic citizens.
But the Tea party which claims to respect the constitution more than anybody else, want to repeal the 14th amendment and deny rights to people born in US.
Did columbus have legal papers when he discovered america? Should his descendants be deemed illegal aliens and thrown out ?
I fully agree with you. If you read the 14th amendment, it is clear that entering without inspection is avoiding the jurisdiction of the United States. So if you entered without inspection, you avoided our opportunity to decide if you can enter or not, thus not subject to jurisdiction. So anchor babies are illegitimate citizens.
